Article 1. Definitions
In the general terms and conditions the following terms are understood to mean:
- Consumer: the natural person who is not acting for purposes relating to his trade, business, craft or profession;
- Day: calendar day
- Right of withdrawal: the option for a consumer to cancel the distance contract within the cooling-off period;
- Distance contract: an agreement concluded between FrancesFalicia.nl and a consumer within the framework of an organised system for the distance sale of products, whereby up to and including the conclusion of the agreement exclusive or partly use is made of one or more techniques for distance communication;
- Distance communication technology: means that can be used to conclude an agreement, without the consumer and FrancesFalicia.nl need not have met in the same room at the same time.

Article 3. Applicability
- These general terms and conditions apply to every offer from FrancesFalicia.nl and to every distance contract concluded between the entrepreneur and the consumer.
- Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer.
Article 4. The offer
- The offer contains a complete and accurate description of the products, digital content, and/or services offered. If the entrepreneur uses images, these are a true representation. Obvious mistakes or errors in the offer are not binding on the entrepreneur.
- If the entrepreneur uses photos, the colours may differ from the original.
- Obvious mistakes or obvious errors in the offer of the products do not bind FrancesFalicia.nl .
Article 4.1 Gift cards
- Gift cards are valid for 1 year from date of issue.
- The gift card does not work in combination with discount codes.
- The gift card does not have to be spent all at once.
- This gift card can only be spent online in our webshop.
Article 5. Right of withdrawal
- The consumer can cancel the agreement regarding the purchase of a product during a reflection period of 14 days (after receipt) without giving any reason.
- After this notification, the consumer has another 14 working days to actually return the product.
- If the consumer exercises his right of withdrawal, he must report this within the specified time by reporting this via klantenservice@francesfalicia.nl
- As soon as this email has been processed, the consumer will be notified.
Article 6. Obligations of the consumer during the cooling-off period
- During the cooling-off period, the consumer must handle the product and its packaging with care. The basic principle is that the consumer may only handle and inspect the product as they would be allowed in a store.
- The consumer is only liable for any diminished value of the product resulting from the handling of the product that goes beyond what is permitted in paragraph 1.
Article 7. Obligations of the entrepreneur regarding the right of withdrawal
- The consumer can exercise their right of withdrawal by sending an email to klantenservice@francesfalicia.nl. As soon as this email has been processed, the entrepreneur will notify the consumer.
- The entrepreneur will reimburse the consumer's payments within 14 days after processing the customer's email, or after the products have been returned as described in Article 6. The reimbursement includes the delivery costs charged by the entrepreneur. In the event of partial termination of the agreement, the delivery costs charged by the entrepreneur will not be reimbursed.
Article 8. Exclusion of the right of withdrawal
- For hygiene reasons, earrings cannot be returned. These products are therefore excluded from the right of return.
- The supply of digital content other than on a tangible medium.
- Gift cards cannot be returned.
- Returning bundled products is only possible if the entire order is returned. Returning partial items is not possible.
- It's not possible to redeem a free product received through a promotion if the purchased product is returned. If this does happen, we will deduct the price of the free product.
Article 9. Returns
- Article 5 states how much time the consumer can take for returning.

- Returns without a name and order number will not be processed.
- Return costs are for the consumer.

Article 10. Obligations of the entrepreneur during the return process.
- Once the retailer has received the customer's return, they will send the customer a confirmation email. This is only possible if the consumer has included the requested information with their return.
- The entrepreneur will refund the price of the product and, if the entire order has been returned, the entrepreneur will also refund the delivery costs charged by the entrepreneur.
- The refund will be made within 14 days after the return shipment has been received in good order.
- If the order has been partially paid with a gift card, the amount will first be refunded to the gift card.
Article 11. Price
- The listed prices are subject to change. In the event of an incorrect price, FrancesFalicia.nl may cancel the purchase and refund the money.
- The prices stated in the offer of products or services include VAT.
- Discount codes cannot be used simultaneously. Only one code is permitted per order.
- Discount codes cannot be used on already discounted items.
- Sale items and specials may be excluded from certain promotions.
- For free (received) items, the rule is: while supplies last.
- No service or rights can be granted on free (received) items. If a free item runs out, a suitable alternative will be offered.
- Certain categories may be excluded from discount codes.
Article 12. Payment
- Payment will be made when placing the order.
Article 13. Duration, termination, extension
- If a product cannot be delivered within 30 days, the consumer and FrancesFalicia.nl have the right to cancel the order without giving any reason.
Article 14. Warranty provisions and complaints procedure
- By Frances Falicia offers a 3-month warranty on jewelry.
- By Frances Falicia offers a one-year warranty against discoloration provided our care instructions are followed. To enjoy your jewelry for longer, By Frances Falicia recommends following these care instructions carefully.
- If you have a complaint, you can email klantenservice@francesfalicia.nl. If this doesn't lead to a resolution, you can submit your dispute for mediation throughWebwinkelKeur .
Article 15. Liability
- Any liability of FrancesFalicia.nl of staff and products from FrancesFalicia.nl FrancesFalicia.nl is expressly excluded from any liability for any damage whatsoever, direct or indirect, including business damage, consequential damage, damage to movable or immovable property, or to persons. liable for damage caused by third parties during the performance of the agreement.
- FrancesFalicia.nl accepts no liability for any damage resulting from the use of FrancesFalicia.nl products.
