Article 1. Definitions

In the general terms and conditions the following terms are understood to mean:

  1. Consumer: the natural person who is not acting for purposes relating to his trade, business, craft or profession;
  2. Day: calendar day
  3. Right of withdrawal: the possibility for a consumer to cancel the distance contract within the cooling-off period;
  4. Distance contract: an agreement concluded between FrancesFalicia.nl and a consumer within the framework of an organised system for the distance selling of products, whereby up to and including the conclusion of the agreement exclusive or partly use is made of one or more techniques for distance communication;
  5. Distance communication technology: means that can be used to conclude an agreement without the consumer and FrancesFalicia.nl  need to have met in the same room at the same time.

Article 3. Applicability

  1. These general terms and conditions apply to every offer from FrancesFalicia.nl and to every distance contract concluded between entrepreneur and consumer.
  2. Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer.

Article 4. The offer

  1. The offer contains a complete and accurate description of the products, digital content and/or services offered. If the entrepreneur uses images, these are a true representation. Obvious mistakes or obvious errors in the offer do not bind the entrepreneur.
  2. If the entrepreneur uses photos, the colours may differ from the original.
  3. Obvious mistakes or obvious errors in the offer of the products do not bind FrancesFalicia.nl .

Article 4.1 Gift cards

  1. Gift cards are valid for 1 year from date of issue.
  2. The gift card does not work in combination with discount codes.
  3. The gift card does not have to be spent all at once.
  4. This gift card can only be spent online in our webshop.

Article 5. Right of withdrawal

  1. The consumer can cancel the agreement regarding the purchase of a product during a reflection period of 14 days (after receipt) without giving any reason.
  2. After this notification, the consumer has another 14 working days to actually return the product.
  3. If the consumer exercises his right of withdrawal, he must report this within the specified time by reporting this via klantenservice@francesfalicia.nl
  4. As soon as this email has been processed, the consumer will be notified.

Article 6. Obligations of the consumer during the cooling-off period

  1. During the cooling-off period, the consumer will handle the product and packaging with care. The starting point here is that the consumer may only handle and inspect the product as he would be allowed in a store.
  2. The consumer is only liable for any diminished value of the product resulting from the handling of the product that goes beyond what is permitted in paragraph 1.

Article 7. Obligations of the entrepreneur in case of right of withdrawal

  1. The consumer can make use of his right of withdrawal by sending an email to klantenservice@francesfalicia.nl. As soon as this email has been processed, the entrepreneur will inform the consumer of this.
  2. The entrepreneur will reimburse the consumer's payments within 14 days after the entrepreneur has processed the customer's email. Or after the products as described in article 6 have been returned. The reimbursement includes the delivery costs charged by the entrepreneur. In the event of partial termination of the agreement, the delivery costs charged by the entrepreneur will not be reimbursed.

Article 8. Exclusion of the right of withdrawal

  1. Due to hygiene reasons, earrings cannot be returned. These products are excluded from the right of return.
  2. The supply of digital content other than on a tangible medium.
  3. Gift cards cannot be returned.
  4. Returning bundle products is only possible if everything is returned. Returning parts is not possible.
  5. It is not possible to keep a free product received by means of a campaign, if the purchased product is returned. If this does happen, we will settle the price of the free product received.

Article 9. Returns

  1. Article 5 states how much time the consumer can take to return the product.
  2. Send an email to klantenservice@francesfalicia.nl stating your name, order number and what you wish to return.

  4. Returns without a name and order number will not be processed.
  5. Return costs are for the consumer.

Article 10. Obligations of the entrepreneur during the return process.

  1. When the entrepreneur has received the return shipment from the customer, the entrepreneur will send the customer a confirmation by email. This is only possible if the consumer has added the requested information to his/her return shipment.
  2. The entrepreneur will refund the price of the product and if the entire order has been returned, the entrepreneur will also refund the delivery costs that the entrepreneur himself has charged.
  3. The refund will be made within 14 days after the return shipment has been received in good order.
  4. If the order has been partially paid with a gift card, the amount will first be refunded to the gift card.

Article 11. Price

  1. The prices mentioned are subject to change. In case of incorrect pricing, FrancesFalicia.nl can cancel the purchase and the money will be refunded.
  2. The prices stated in the offer of products or services include VAT.
  3. Discount codes cannot be used simultaneously. Only 1 code per order.
  4. Discount codes cannot be used on items that are already discounted.
  5. Sale items and specials may be excluded from certain promotions.
  6. For free (received) items, the rule is while supplies last.
  7. No service or rights can be granted on free (received) items. If a free item is used up, a suitable alternative will be offered.
  8. Certain categories may be excluded from discount codes.

Article 12. Payment

  1. Payment will be made when placing the order.

Article 13. Duration, termination, extension

  1. If a product cannot be delivered within 30 days, the consumer and FrancesFalicia.nl have the right to cancel the order without giving any reason.

Article 14. Warranty provisions and complaints procedure

  1. By Frances Falicia offers a 3-month warranty on jewelry.
  2. By Frances Falicia gives a 1 year guarantee on discolouration provided our care tips are followed. To enjoy your jewellery for a long time, By Frances Falicia advises you to follow the care tips carefully.
  3. If the consumer has a complaint, the consumer can email klantenservice@francesfalicia.nl. If this does not lead to a solution, it is possible to register your dispute for mediation via Stichting WebwinkelKeur. As of 15 February 2016, it is also possible for consumers in the EU to register complaints via the ODR platform of the European Commission. This ODR platform can be found at http://ec.europa.eu/odr . If your complaint is not yet being handled elsewhere, you are free to file your complaint via the European Union platform.

Article 15. Liability

  1. Any liability of FrancesFalicia.nl  of staff and products from FrancesFalicia.nl  for all damages of any nature, direct or indirect, including business damage, consequential damage, damage to movable or immovable property or to persons, is expressly excluded. Nor is FrancesFalicia.nl  liable for damage caused by third parties during the performance of the agreement.
  2. FrancesFalicia.nl accepts no liability for any damage resulting from the use of FrancesFalicia.nl products.
